TERMS OF SERVICE

  1. About Noble Tail Co.

These Terms of Service apply to the website nobletailco.com and purchases made through Noble Tail Co.

Noble Tail Co. is a trading name of:

NOBLE TAIL CO.
Registered office: No address
Email: support@nobletailco.com

In these Terms, “Noble Tail Co.”, “we”, “us” and “our” refer to the legal business identified above.

“You” and “your” refer to the website visitor or customer.

  1. Acceptance of These Terms

By accessing the website or placing an order, you agree to these Terms, together with our:

• Shipping Policy;
• Returns and Refunds Policy;
• Privacy Policy;
• Cookie Policy; and
• any product-specific terms shown before purchase.

If you do not agree, you should not use the website.

  1. Consumer Rights

Nothing in these Terms removes, restricts or replaces any mandatory consumer rights available under applicable law.

Where these Terms conflict with a mandatory consumer protection, the mandatory protection takes priority.

  1. Eligibility

You must be legally capable of entering into a binding contract.

Where a customer is below the age of legal capacity in their country, an order must be placed by or with the consent of a parent or legal guardian.

Our products are intended for purchase by adults and are not marketed directly to children.

  1. Product Information

We take reasonable care to present accurate product descriptions, photographs, sizes, materials, colours and features.

However:

• screen settings may affect colour appearance;
• measurements may have reasonable manufacturing tolerances;
• packaging may change;
• minor design details may vary between production batches; and
• products may be dispatched from different approved fulfilment locations.

Any material feature on which you rely should be checked before ordering.

  1. Product Images

Product images are for illustration and identification.

Accessories, pets, furniture or decorative items shown in lifestyle photographs are not included unless expressly stated.

  1. Sizing

Customers are responsible for reviewing the measurements and size guidance provided.

Pet size labels such as small, medium or large can differ between products.

Measure your pet and compare the measurements before ordering collars, harnesses, beds, clothing or other size-sensitive products.

  1. Product Availability

Products are subject to availability.

Adding a product to the basket does not reserve stock.

We may cancel and refund an unavailable product even after an order has been placed.

  1. Prices

Prices are displayed in the currency selected for the relevant Shopify market.

Prices and promotions may change without notice, but changes will not normally affect an order already accepted.

Taxes, import charges and duties are handled as described at checkout and in our Payment and Shipping Policies.

  1. Placing an Order

Submitting an order is an offer to purchase the selected products.

An automated order confirmation acknowledges receipt but does not always mean that the order has been finally accepted.

Acceptance occurs when we confirm fulfilment, dispatch the product or otherwise expressly accept the order.

  1. Refusal or Cancellation of Orders

We may refuse or cancel an order where:

• the product is unavailable;
• a pricing or description error has occurred;
• payment is declined or reversed;
• fraud or unauthorised activity is suspected;
• delivery is unavailable to the destination;
• product-safety or legal restrictions apply;
• purchase limits have been exceeded; or
• the customer has materially breached these Terms.

Where payment has been taken for a cancelled order, an appropriate refund will be issued.

  1. Third-Party Fulfilment

Products may be stored, packed and dispatched by third-party suppliers, warehouses or fulfilment partners.

The use of a fulfilment partner does not remove Noble Tail Co.’s obligations to the customer.

Orders may be divided into separate shipments.

  1. Delivery

Delivery is governed by our Shipping Policy.

Risk of accidental loss or damage passes in accordance with applicable consumer law, normally when the product is delivered into the physical possession of the customer or a person identified by the customer.

  1. Returns and Refunds

Returns, cancellations, faults and refunds are governed by our Returns and Refunds Policy and any mandatory consumer rights.

  1. Pet Safety and Supervision

Many pet products require active supervision.

Customers must:

• choose an appropriate product and size;
• read and follow instructions;
• inspect products regularly;
• keep unsuitable small components away from pets and children;
• discontinue use when damage appears; and
• supervise pets where reasonably required.

No toy, leash, bed, grooming product, feeder or accessory is indestructible.

  1. Electrical and Battery Products

Electrical or battery-powered products must only be used:

• with the specified voltage;
• with a suitable charger or power supply;
• in accordance with supplied instructions;
• away from water unless expressly rated for water exposure; and
• under appropriate supervision.

Stop using any electrical product that overheats, swells, leaks, emits an unusual smell or becomes damaged.

  1. Laser and Light-Based Pet Toys

Never direct a laser or bright light into the eyes of a person or animal.

Use light-based toys only as instructed and supervise play.

Noble Tail Co. does not provide veterinary or medical advice regarding a pet’s suitability for a particular product.

  1. No Veterinary Advice

Website content is provided for general product information.

It is not veterinary, medical, behavioural or nutritional advice.

Consult a qualified veterinary professional where you have concerns about:

• illness;
• injury;
• diet;
• allergies;
• skin conditions;
• anxiety; or
• suitability of a product for a particular animal.

  1. Website Accounts

Customers are responsible for:

• keeping login details confidential;
• providing accurate account information; and
• notifying us of suspected unauthorised access.

We may suspend an account where misuse, fraud or security risks are identified.

  1. Acceptable Use

You must not:

• use the website for unlawful purposes;
• interfere with its security or operation;
• upload malicious code;
• scrape or extract content without permission;
• attempt unauthorised access;
• impersonate another person;
• submit false reviews; or
• use the website to infringe another party’s rights.

  1. Intellectual Property

Unless otherwise stated, the website’s branding, text, graphics, layout and original content belong to Noble Tail Co. or are used under licence.

You may use the website for personal shopping purposes.

You may not reproduce, distribute, commercially exploit or create derivative works from protected content without permission.

  1. Reviews and Customer Content

Where you submit a review, photograph or other content, you confirm that:

• it reflects a genuine experience;
• it is accurate to the best of your knowledge;
• you own or control the content;
• it does not infringe another person’s rights; and
• it is not unlawful, abusive or misleading.

You grant Noble Tail Co. a non-exclusive licence to display and use submitted content in connection with the store and its marketing, subject to applicable privacy and consumer law.

We may moderate content but will not remove a genuine negative review merely because it is unfavourable.

  1. Third-Party Services and Links

The website may use or link to third-party services, including payment providers, social networks, Shopify applications and delivery services.

Third parties may have their own terms and privacy policies.

We are not responsible for an unrelated third-party website merely because it is linked from our store.

  1. Website Availability

We aim to keep the website accessible and secure but do not guarantee uninterrupted availability.

Access may be affected by maintenance, technical faults, hosting providers, security events or circumstances outside our reasonable control.

  1. Liability

Nothing in these Terms excludes or limits liability where exclusion would be unlawful, including liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation; or
• breach of mandatory consumer rights.

Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you purchase as a consumer, we are not responsible for business losses arising from personal use of a product.

  1. Events Outside Reasonable Control

We are not responsible for delay caused solely by circumstances outside our reasonable control, such as:

• natural disasters;
• war or civil unrest;
• carrier disruption;
• customs action;
• strikes;
• government restrictions;
• major network failures; or
• public-health emergencies.

We will take reasonable steps to reduce the effect and will respect any rights the customer has to cancel where delays become excessive.

  1. Governing Law

These Terms are governed by the laws of England and Wales.

A consumer may also benefit from mandatory rights and the jurisdiction of the courts in the country where they habitually live.

Nothing in this clause removes such mandatory rights.

  1. Changes to These Terms

We may update these Terms to reflect changes in our services, practices or legal obligations.

The date at the top shows the latest revision.

The terms in force when an order is placed will generally apply to that order.

  1. Cookies and Advertising

We use cookies and similar technologies as described in our Cookie Policy.

Non-essential analytics and advertising technologies will be controlled according to applicable consent requirements.

In certain jurisdictions, advertising cookies may be treated as targeted advertising, sharing or a sale under local definitions, even where no money is exchanged for personal information.
